The Federal Court of Australia has ended the final Roundup case in the country, thereby resolving all outstanding injury litigation. Roundup is a brand name of herbicide originally produced by Monsanto, which Bayer acquired in 2018.
The Court approved the plaintiffs’ motion to terminate the Fenton class action against Monsanto, which involved claims related to Roundup. This decision follows the company’s prior success in the McNickle case in the same court.
The McNickle case marked the first definitive judgment regarding the potential link between glyphosate, the active component of Roundup, and non-Hodgkin lymphoma (NHL) outside the United States. The Court delivered a comprehensive 322-page ruling, determining that the preponderance of scientific evidence does not establish a connection between glyphosate and NHL.
Bayer has stated that this ruling aligns with global regulatory and scientific evaluations, including those from the Australian Pesticides and Veterinary Medicines Authority (APVMA), which have concluded that glyphosate is not carcinogenic.
In the United States, Bayer plans to maintain its multifaceted approach to effectively manage the Roundup litigation. The company has secured favourable outcomes in 15 of the last 22 trials, demonstrating a strong record in court. Bayer intends to continue presenting cases based on the “overwhelming scientific and regulatory evidence supporting the safety of glyphosate.”
